The article provides a succinct and panoramic assessment (evaluation) on the effectiveness of social rights, using as an analytical-descriptive methodology the reflection on the main processes that have taken place since 1988 with the promulgation of the Brazilian Constitution conducted by the Executive, Legislative
and Judiciary in terms of advances, challenges and impasses in the matter. However, without intending to exhaust the subject since our purpose at the end is to bring some proposals for changes in the described framework capable of promoting the effectiveness of social rights. The study develops a critical and
proactive analysis of the effectiveness of social rights in order to update the debate, make a brief analysis and seek ways to improve democracy through the fullest exercise of citizenship, especially aimed at the sustainable development of the Brazilian State, undermined by problems caused by marginalization and
social exclusion. The purpose of scientific assessments is to cooperate to improve legal institutions and public policies on the effectiveness of social rights.
