Abstract

Resumo: O trabalho aqui exposto visa explorar a polêmica a respeito da legitimidade democrática da teoria das cláusulas pétreas, bastante discutida no âmbito constitucionalista. Para oxigenar a discussão e partir de uma nova perspectiva, este artigo tem como base de reflexão a Ação Direta de Inconstitucionalidade n. 4.543, que invalidou dispositivo legal que estabelecia a impressão do voto. O artigo demonstra a dificuldade existente em se confiar à Jurisdição Constitucional a função contra-majoritária e a proteção das cláusulas pétreas. Abstract: This work here exposed aims to explore the controversy about the democratic legitimacy of the stony clause’s theory, continually discussed on the constitutionalist ambit. To oxygenize and depart from a new perspective, this article has as base of reflexion the Unconstitutionality Direct Action n. 4.543, which nullified the legal disposition that had established the printed vote. The article demonstrates the difficulty of trusting the contra-majoritarian function and the protection of the stony clauses to the Constitutional Court.
