The tyranny as a juridical category of government: the construction of the medieval ius publicum in the work of Bartolo de Saxoferrato

Abstract

The purpose of this research is to analyze the tyranny in the literary work of Bartolo de Saxoferrato as a juridical category. Therefore, it is done a literature review about the formation of ius publicum and an analyze of Bartolo’s Tratactus De Regimine Civitatis and Tyrannidis. We perceived that a sophisticated juridical construction allied to a political pragmatism so that Bartolo’s work gives ingenious solutions to the questions related to the legitimacy of the communal power in the XIV century.
