The purpose of this research is to analyze the tyranny in the literary work of Bartolo de Saxoferrato as a juridical category. Therefore, it is done a literature review about the formation of ius publicum and an analyze of Bartolo’s Tratactus De Regimine Civitatis and Tyrannidis. We perceived that a sophisticated juridical construction allied to a political pragmatism so that Bartolo’s work gives ingenious solutions to the questions related to the legitimacy of the communal power in the XIV century.
