Colombian and Brazilian Social and Democratic Rule of Law
A reflection on the intersection of constitutional limitations on property rights

This article aims to compare and reflect how limitations to the right to property in Colombian and Brazilian rights. With this purpose, the consolidation of the Social and Democratic State of Law, in Colombia and Brazil, the meaning of economic constitution and the protection conferred to property throughout history were investigated. From the deductive method and the law in comparison, through bibliographic and legislative research, it was verified that the main constitutional provisions, Colombian and Brazilian, concerning property, finally, a social function is competent as an intersecting element for limiting this right, promoting the goals of nations and meeting the collective interest.
