Regulatory Impact Analysis (RIA) and social participation in Brazil

This paper investigates the Regulatory Impact Analysis (RIA) role in the Brazilian government regulatory paradigm, identifying its peculiarities and its social participation challenges and potencialities. The deductive method approach was adopted, besides bibliographic, legislative and documental research techniques.
The results shows that RIA is an evidence verification procedure used to determine regulation changes, particularly highly technical ones. Despites its high techinicality, the procedure is permeable to social participation, occurring in its preparation phase and in the deliberation process itself. Although the challenges faced (capture and information asymmetry), social participation represents an instrument for legitimating and improving regulatory policy, as well as leading to the adoption of a responsive regulatory model.
