Resumen

O artigo aborda o instituto da enfiteuse, enquanto direito real, e a sua abolição relativa a Prédios Rústicos à Luz da Constituição da República Portuguesa de 1976. A enfiteuse é um direito real que se dá quando o proprietário de qualquer imóvel transfere seu domínio útil para outra pessoa, obrigando esta a pagar anualmente pensão determinada, a qual se chama fôro ou cânon. O artigo faz uma análise histórica do instituto da enfiteuse, confrontando-a com a recente legislação portuguesa, que a aboliu, e as possíveis inconstitucionalidades materiais da legislação ordinária relativa a predios rústicos.
