Os bens comuns e a recepção pelo Direito Civil: análise a partir da experiência italiana

The objective of this article is to reflect on the legal validity of the commons goods, based on the Italian popular initiative bill (Progetto di legge di iniziativa popolare). The deductive approach method and the monographic procedure method are used. The text is developed in two sections: "Roman Law and the Codification of the Common Goods" and "Contributions of Italian Civil Law to the Common Goods: Analysis of the Rodotà Commission Project". It is possible to conclude by the necessity of (re)thinking about the categories of goods existing in the Legal System, especially the possibility of opening the legal system to the commons.
