The Unforeseen Theory and Public Crisis Management in Brazil

In exceptional situations, circumstances erupt that impact this predictability, instigating the daily routine, such as the occurrence of the pandemic generated by COVID-2019. In such cases, the exceptionality of the context must be accompanied by the exceptionality of the measures that, with extreme urgency, must be adopted, in order to amortize as much as possible, the negative effects arising from it. Considering this scenario, this article aims to analyze the theory of unpredictability within the scope of public management in Brazil. Initially, it addresses the unforeseen, based on the act of God and force majeure, followed by the examination of the unforeseen in relation to proportionality. Then, it addresses the theory of unpredictability and the clause rebus sic stantibus, and the unpredictability in times of pandemic, to then address the political, economic, and legal measures adopted in Brazil.
