This paper focuses on the protection of the right to property, regulated in the art. 1 of the first Protocol Additional to the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) and enforced by the European Court of Human Rights (which has the power to hold states
accountable for a failure to respect the rights contained in the Convention). Italy has been repeatedly condemned by the European Court of Human Rights for the continuous violations of art. 1 of the first Protocol Additional to the European Convention. To ensure a real effectiveness of the ECHR system, there is a need to strengthen and enhance the authority of Convention rights at national level.
