Society of (Mis)information: a longitudinal analysis of jurisprudence and decisions of the TSE on fake news in elections (2018-2022)

The objective of this article is to conduct a quantitative and longitudinal analysis of the jurisprudence and decisions of the Superior Electoral Court (TSE) from the 2018 elections to the pre-electoral period of 2022. The hypothesis is that during this period, there was a transition from a relatively flexible stance towards the use of disinformation in Brazilian politics to a more stringent policy regarding the regulation of fake news. This process culminated in the TSE's decision to revoke the mandate of Congressman Fernando Francischini in October 2021, making him the first Brazilian politician to be ousted due to the dissemination of disinformation. To carry out this quantitative and longitudinal mapping of the decisions, we will analyze the content of the decisions' summaries. Among the conclusions of this study, we highlight the characterization of the actors who had the greatest influence on the debates, as well as the monocratic nature of a significant portion of the decisions.
