This paper aims to reinforce the importance of the inclusion of consumer protection in the Brazilian Federal Constitution of 1988, establishing a discussion on overcoming the mass society for the ticket in a hyperconsumist society and highlighting the importance of applying the principle of solidarity in this society that worships the disposable. The Constitution federal enshrined in 1988 consumer protection as a fundamental right and immutable clause. In these three decades beyond the mass consumption society to become hyperconsumist and, in this scene, if rescues the principle solidarity as one of the ways to harmonize relations between consumers and suppliers.
