Social assistance benefits and foreigners: a comparative analysis between brazilian and chilean law

The current paper presents a comparative analysis between Brazilian and Chilean law concerning the possibility of granting assistance benefits to resident aliens in Brazil and in Chile. The work is divided in two parts aiming to discuss the proposed problem. The first part approaches the Brazilian legal system, explores the guidelines of social assistance in Brazil, the requirements for the Assistance Benefit of Continued Provision and the (im)possibility of granting the benefit to resident aliens. The second part analyzes the Chilean normative system. It approaches the social assistance structure, the assistance benefits in Chile as well as its limitations regarding assistance benefits to foreigners. In this study, it was applied the bibliographic research method from a qualitative approach. It was also taken into consideration doctrines, laws and the jurisprudence related to the theme.
