Abstract

This article focuses on the application of the pro homine principle by regional human rights protection systems. The objective of the article is to identify how the European, Inter-American and African human rights protection systems apply this principle. Thus, methodologically, the article is guided by an inductive research, with documentary instruments, analyzing the decisions of the regional human rights courts. As a theoretical reference, the concept of humanization of the law developed by Antônio Augusto Cançado Trindade is adopted. Structurally, the article is composed of an analysis of the humanization of international law as the origin of the pro homine principle, a dialectical analysis between the universality of human rights and the regionalism of protection systems, and a taxonomic description of the application of the pro homine principle by regional human rights systems.
