Abstract

ABSTRACT: The purpose of this paper is to understand how the relations between by one side, the Brazilian and the State of Santa Catarina Governments and the Indigenous Peoples, by another side are strategically defined as “allies or enemies” and how these definitions determined the way in which historically and legally several Indigenous ethnicities were impacted by territorial demarcation policies and agrarian conflicts in Santa Catarina. To put this study in march a qualitative methodology was utilized, based on based on documentary research thar consisted in the consultation and analysis of documentary sources such as books and legal papers. Though this research it was possible to perceive that these Indigenous Peoples labeled as “allies” or “enemies” have been impacted in the dynamics of their rights even after the promulgation of the 1988 Brazilian Constitution. This occurred in the case of “allied” ethnicities that actively contribute to the interests of the Government, but it also occurred in the case of those “enemy” ethnicities, who only seek for better living conditions beyond those policies proposed by the Government.

  • Luiz Aristeu dos Santos Filho, Universidade da Região de Joinville - Univille

    Professor of the Law Course at the University of the Region of Joinville (UNIVILLE) - São Francisco do Sul Unit, Professor of Sociology, linked to the Department of Education of the State of Santa Catarina, has worked as a lawyer for the Municipality of São Francisco do Sul - SC, integrating the Municipal Legal Department, working in Tax Execution and having worked directly in the Municipal Secretariat for Social Development and Citizenship (SDSC) and in the Specialized Reference Center for Social Assistance (CREAS). He worked in the Purchasing Sector of the Municipal Administration Department and in the Municipal Department of Housing, Social Development and Citizenship (SHDSC). Former member and former Vice-President of the Municipal Council for the Rights of Children and Adolescents of São Francisco do Sul (CMDCA-SFS), former member of the Municipal Council for the Rights of the Elderly of São Francisco do Sul (CMDI-SFS) . He worked as a Teaching Fellow in Technical courses and Initial and Continuing Training courses at PRONATEC at the Instituto Federal Catarinense on the São Francisco do Sul Campus (IFC-SFS), focusing on "Ethics, Citizenship and Human Relations" and "Legislation". He has already acted as a tutor for the subjects "Politics I" twice, "Politics III" and "Sociology of Education", in the Sociology Degree course at UAB-UFSM. He was a monitor for the subjects "Final Undergraduate Work I" (twice) and "Theory of the State", in the Law course and "Research in Administration" (I and II), in the Administration course. He was an academic-researcher at UNIFRA, part of the research group "Legal Theory in the New Millennium" and is an academic-researcher at UFSM in the group "Political Institutions", having also been part of the research group "Citizenship, Multiculturalism, Powers and Integration Processes ". PhD student in Cultural Heritage and Society at the University of the Joinville Region (Univille) Joinville Unit. Master in Social Sciences (2011) from the Federal University of Santa Maria (UFSM), in the research line "Institutions and Political Thought". Specialist in Integrated Teaching of Philosophy, Geography, History and Sociology (2019) from the Federal Institute of Santa Catarina (IFSC). He has a degree in Sociology (2008) and a bachelor's degree in Administration (2005) and Social Sciences (2001), all courses from the Federal University of Santa Maria (UFSM). He also has a Bachelor's degree in Law (2008), from the Franciscan University Center (UNIFRA), in the research line "Legal Theory, Citizenship and Globalization". Consultant and Speaker.     Professor of the Postgraduate Program in Cultural Heritage and Society, of the Law and Psychology Course at the University of the Joinville Region - Univille. He has a post-doctorate from the University of Coimbra and Center for Studies in Human Rights - Ius Gentium Conimbrigae - in the area of Democracy and Human Rights (2013), with a Master's degree (2008) and Doctorate in State Law from the Postgraduate Program in Law from the Federal University of Paraná (2012). Researcher with experience in the areas of Cultural Rights, Cultural Heritage, Criminology, History of Law and Human Rights, focusing on the study of Culture, Subjectivities, Sustainability, Memory and their relationships with fundamental rights. She has a degree in Law from the Pontifical Catholic University of Paraná (PUC-PR) (2005) and in Psychology from the Federal University of Paraná (2005). Specialist in Criminal Law and Criminology from ICPC - UFPR (2006). Attorney. Member of the Brazilian Institute of Cultural Rights - IBDCULT.

    Possui graduação em Direito pela Universidade Estadual de Maringá (2000), especialização em Direito Civil e Processual Civil pelo Centro Integrado de Ensino Superior (2002), especialização em Direito e Negócios Internacionais pela Universidade Federal de Santa Catarina (2004) e mestrado em Direito na área de Relações Internacionais pela Universidade Federal de Santa Catarina (2006). É doutora em Direito pela Universidade Federal de Santa Catarina (2010) e doutoranda em direito na Universidad de Valencia. Trabalha como professora na Universidade da Região de Joinville, na qual leciona no departamento de Direito e no Mestrado em Patrimônio Cultural e Sociedade. Nesta universidade também exerce a função de assessora jurídica do Núcleo de Inovação e Propriedade Intelectual (NIPI) e do Parque de Inovação Tecnológica da Região de Joiniville (INOVAPARQ). Também é professora do Programa de Pós-graduação em Propriedade Intelectual e Transferência de Tecnologia para Inovação (PROFNIT) - ponto focal UFSC. É pesquisadora e consultora nas áreas de: Direito, com ênfase em Propriedade Intelectual (propriedade industrial e direito autoral), proteção e contratação de tecnologia, inovação, pesquisa e desenvolvimento (P&D), contratos internacionais, desenvolvimento, direito internacional privado e proteção do patrimônio cultural.
