This study analyzes the social function of education in complex societies, through the approach of the democratic versus neoliberal conception of education and the idea of the constitution of the Post-Democratic State in the logic of the new capitalism. The methodology is a bibliographic review based on theoretical and legal hermeneutics of the Federal Constitution of 1988. The main problem addressed is: how can, should or should not education exercise the social function of preponderance of public interest over private interest to alleviate the conflicting tensions intrinsic to complex societies in a democratic state? The hypothesis is raised that the social function of education in complex societies is to provoke awareness of human dignity. Thus, it collaborates in provoking critical action to provide basic conditions in capitalist society through citizenship and democracy, claiming the role of popular sovereignty in controlling the Democratic State of Law.
