Author Guidelines

The Justice of the Law journal - ISSN 1413-7038 - is a semiannual scientific journal that works with call for papers in continuous flow and aims to promote the improvement of studies in the field of ​​Law, especially in New Paradigms of Law. This area relies on two lines of research: Constitutional Jurisdiction and Democracy, Social Relations and Dimensions of Power.

Constitutional Jurisdiction and Democracy

The Constitutional Jurisdiction and Democracy research line has as its purpose the study of the constitutional jurisdiction foundations, the role of the State in the achievement of public policies, the role of the State in the intervention of the economy and the crossing that public law does in private rights, under the prism of a theory of fundamental rights.

 Social Relations and Dimensions of Power

The line of research Social Relations and Dimensions of Power has as its focus the dissemination of papers that address studies of democracy in the paradigm of the contemporary Constitutional State, with emphasis on the most diverse issues, such as: the Federative pact; the respective negative and positive guarantees in terms of Criminal Policies; the role of the new social subjects that are inserted in this new form of State and of Constitution; and, finally, justice systems. It is in the latter that the constitutional process is seen as a methodology for guaranteeing fundamental rights, the problem of access to justice and the solution through the new paradigms that provide an effective judicial protection without forgetting the essential functions of Justice and the alternative of means of its realization in the State of Right.

Guidelines for Authors 

1. Sending texts 1.1 Articles and reviews submitted must comply with these guidelines and be submitted directly through the journal's page: www.upf.br/seer/index.phd/rjd 1.2 Exceptionally, relevant articles that have already been published may be accepted, provided that due authorizations are granted, at the discretion of the editor-in-charge. 1.3 Articles should not be forwarded by e-mail to the editor-in-charge of the journal. 

2. Basic guidelines 2.1 The wording of the article, when written in Portuguese, must conform to the rules of the new Portuguese Language Orthographic Agreement. 2.2 The bibliography of the paper should be consistent and also show, whenever possible, the position of foreign lecturers on the subject.

3. Nature and basic elements of the articles 3.1 As a rule (see 1.1 and 1.2 above), articles must be unpublished, written in Portuguese, Spanish or English, and must comply with the following content and in this order: title, title in English, abstract, key-words, introduction (should not be numbered), development (divided into numbered items), final considerations (should not be numbered) and references numbered and in alphabetical order). All bibliographical and documental references (normative documents, among other documents) of the sources cited in the text (not numbered and in alphabetical order) must be presented in the end of the article. 

3.2 These topics should be clearly highlighted/specified throughout the text. Sub-headings, if any, should be concise and clearly indicated. 

3.3 Titles, titles of divisions and subdivisions of texts must be written in lowercase, bold, and numbered progressively. 

3.4 The article must be submitted without the identification of the author (s), which should include his / her data and biography, including institution to which he / she is connected, city, state, country, title, e-mail address, by the journal's electronic system. (the author biography can be registered in the metadata if not included in the authors profile).

3.5 Abstract in Portuguese and English or in the source language, highlighting objectives, methodology and synthesis of the final considerations (maximum 150 words). 

3.6 Indication of a maximum of five keywords and / or expressions of the text, in Portuguese or in the source language and English, which should reflect the basic ideas of the text and guide the research of interested third parties. 

3.7 References must be in alphabetical order of the first letter of the Author's Last Name and appear at the end of the papers, according to the ABNT (in the article the item should be called "References" and not "Bibliographic References", as it includes documental references) and according to the rules contained in these guidelines, especially items 8 and 9; 

4. Responsibility: The submitted papers are the exclusive responsibility of the authors and it is considered implicit the authorization for their publication, being the responsibility of the authors the authorship of the content, as well as opinions issued of any nature, be they scientific, technical or political. The content of the signed articles does not reflect the opinion of the Journal of the Law Faculty of the University of Passo Fundo – Law Justice. In the case of articles produced by financing related to the paper to be published, it is necessary to indicate the financing institution.

5. Co-authoring: No more than three (3) authors are possible present an article to the Journel, all of which must be identified as specified in item 3.4 above; Only papers by authors with a doctorate in progress or completed will be considered. 

6. Article Submission Limits: Each author (individually or in co-authorship) may submit only one paper per call of the Justice of Law Journal

7. Elementary Article Structure Settings and Reviews 7.1 letters in Arial Font, size 12 7.2 line spacing: 1.5 7.3 margins of 3 cm 7.4 sheet: A4 7.5 text editor: Word for windows 6.0 or later 7.6 paragraph: back and anterior spacing: 0 point 7.7 justified alignment, 7.8 paragraph entry of 1.25 cm; 

8. Quotes and notes 8.1 Small textual quotations (up to three lines) must be inserted in the text, between quotation marks and without italics. 8.2 Long textual quotations (more than three lines) should come in an independent paragraph, indented from the left margin 4 cm, with Arial 10, and with single spacing, without quotation marks. 8.3 The indication of authorship should be made in footnotes and not in an article's endnote (indicate the complete reference of the work in the first citation and, afterwards, only show the author's name, the title of the work and the page number, as instructed in item 9 below). 8.4 Articles that use the author-date mode or expressions such as OptCit, Idem, and Ibidem will not be accepted. 8.5 The name of the papers must be in bold, not in italics. 8.6 Footnotes should be kept to the minimum necessary. 8.7 When text is translated: use "Translation of…" (not Trad.).

10. Size of articles: Articles must have a minimum of fifteen (15) and a maximum of twenty five (25) pages, including the references;

11. Notification of the result of the submission: The authors will be notified about the result of the evaluation of their articles by e-mail. 

12. The Journal does not apply the collection of fees or other amounts for the review and / or publication of articles.

ETHICAL PRINCIPLES

The Law of Justice Journal observes the best practices in publishing and research ethics in accordance with internationally established guidelines, including the Code of Conduct and Good Practices Guidelines for Newspaper Editors, published by the Public Ethics Committee (COPE). We have listed some of the policies we have adopted in this regard, in order to reinforce and complement those discussed in the “Guidelines for Authors”.


Publisher Responsibilities

The Editors of the Law of Justice Journal have the responsibility to act in a balanced, objective and fair manner in the performance of their duties, without any form of discrimination.

All submissions are processed following the standard procedure adopted by the journal, so that articles are considered and accepted solely because of their academic/scientific merit and without commercial or political influence.

The Editors adopt and follow fair and coherent procedures in case of situations of an ethical nature or conflict, as well as giving authors the right to respond to the evaluation decisions to which they are submitted.


Responsibilities of evaluators/reviewers

The reviewers who make up the Law of Justice Journal evaluator's bank have the responsibility to contribute to the decision-making process of the publication of a scientific paper, helping in a relevant way to improve the quality of the published article, revising the manuscript objectively within the deadline established in the "Guidelines for Authors ".

They must maintain the confidentiality of any information provided by the publisher or the author (s), and the retention or copying of the manuscript is prohibited.

In addition, they should alert the publisher if they identify published content (s) or submissions with suspicion of plagiarism and auto-plastering, that is, substantially similar to that under review.


Responsibilities of the author(s)

The author(s) submitting their scientific work(s) to the Law of Justice Journal is(are) responsible for the journal's requirements regarding the novelty and other ethical and methodological requirements of the journal, contained in the "Guidelines for Authors".

Thus, the submitted article must be unpublished, not being subject to another evaluation process, nor published in any other national or foreign journal, unless it is published in another language and in another country, a situation in which there should be a citation that this is an article version already published in another journal.

The author(s), at the time of submitting the scientific work, adheres to the unpublished clause, becoming aware that, even after approval and publication of the article on the journal's website, identified any irregularities with respect to the ethical issue of publication, it will be immediately withdrawn and, instead, information will be included that "the article was withdrawn due to ethics in the publication".

The scientific papers submitted by the authors, in order to be accepted for publication, must comply with the following rules:

  1. a) be appropriate to the lines of research adopted by the journal;
  2. b) comply in full with the rules indicated in the “Guidelines for Authors”;
  3. c) the author(s) automatically declare, at the time of submission, the work’s assignment of the right for an indefinite period, as well as the rights to exhibit, publish, reproduce, store and/or any other form of it, what is did in an express, irrevocable and irreversible manner and in full right, in a gratuitous and without any remuneration, burden or charge, in favor of the Law of Justice Journal;
  4. d) assure that the collaboration submitted is original, recognize and cite the content reproduced from other sources;
  5. e) the author(s) shall ensure that any studies involving humans or animals comply with national, local and institutional laws and requirements;
  6. f) declare any potential conflict that may be considered or seen to have undue influence on the process of publication.

 
Editorial Duties Concerning Unethical Behavior

Any unethical manifestation identified in the scientific works published in the Law of Justice Journal can be brought to the publisher's attention at any time by any person, since such person provides sufficient information and evidence for an investigation to be initiated.

Evidence should be collected while avoiding spreading any claims beyond those that need to be reported.

In any case, the author should have the opportunity to respond to any allegations.

Our articles are evaluated by pairs to guarantee the quality of the scientific publication, firstly they are screened prior to distribution to the evaluators where parallel to the pre-evaluative criteria the FAREJADOR self-plagiarism software is used.

Inform or notify the author or reviewer where there appears to be misunderstanding or misapplication of acceptable standards.

Retraining or formal withdrawal of publication of the journal.

Once the investigation procedure has been completed and once unethical behavior has been established, no further contributions from the investigated author will be accepted.
