For a genealogy of human rights: on modernity and coloniality

Abstract

This article consists of a brief genealogy of knowledge production and historical affirmation of Human Rights, given the path of western expansion, eurocentric thinking and universal modernity. In this context, the work questions the limits of the concept and criticize modernity/coloniality and humanism of Human Rights. In this text, there is a need to confront Human Rights when they assume the legacy of modernity, as much as it is necessary to take in account, rescue and emphasize knowledge that was subjected, excluded and concealed during the course of western formation of these rights. Likewise, it is necessary to strengthen the entire history of resistance, social struggle and institutional change associated with these rights, which are also decisive for their formation.

    Doutor em Teoria do Estado e Direito Constitucional da PUC-RIO (2016-2021), com formação em cotutela na Université Paris Nanterre (PARIS X - Ecole Doctorale - Droit et Science Politique). Mestre em Jurisdição e Direitos Humanos pela UNICAP/PE, com mestrado-sanduíche na UNISINOS/RS (2014). Participei da 'London Critical Theory Summer School' (LCTSS - 2015), promovida pelo Birkbeck Institute for the Humanities (University of London) e da construção do I, II e III Seminário Internacional de Pós-Colonialismo, Pensamento Descolonial e Direitos Humanos na América Latina (UNISINOS/RS - 2013, 2017 e 2018). Além de ser co-coordenador do grupo de estudo “Democracia que vem” na PUC-RIO (2017-2018). Trabalho temas de Direito Público, Filosofia e Teoria do Direito, do Estado e da Política. Especialmente, estudo Teoria Crítica dos Direitos Humanos e Filosofia Política contemporânea, a partir de autores como Michel Foucault, Jacques Derrida, Giorgio Agamben, Achille Mbembe, Costas Douzinas e Gilles Deleuze.
