Abstract

The article discusses personality rights in the digital age, focusing on the applicability of these rights to adult content producers who voluntarily share explicit content on online platforms for commercial purposes. The issue at stake is what legal regime is appropriate for resolving problems involving such content, given that it is produced for commercial purposes and voluntarily made available. The premise adopted is that voluntary exposure is a mercantile act subject to private law rules. The objective is to justify the application of private law instead of resorting to personality rights. The research is bibliographic-documentary and adopts a hypothetical-deductive reasoning.
