Article 19 of the Brazilian National Education Guidelines and Framework Law assigns three administrative categories to educational institutions: public, private, and community. This article focuses on Community Higher Education Institutions (CHEIs) and aims to highlight their non-state public character and strategic importance for emancipatory social education. The research analyzes the literature review and legal provisions. The results show that strengthening educational democracy depends on the establishment of community higher education; that partnerships between the government and CHEIs lead to greater inclusion and retention; and that CHEIs demonstrate significant social responsibility, promoting regional development. It concludes that the regulation of Law No. 12.881/2013 is necessary to preserve the sustainability of CHEIs and support the higher education expansion policies foreseen in the National Education Plan.
